1 Appellant, Roman Hildebrandt, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Comanche County, Case No. CRF-72-58, for the offense of Illegal Distribution of Lysergic Acid Diethylamide. His punishment was fixed at five (5) years imprisonment and a fine of Five Hundred Dollars ($500.00). From said judgment and sentence, a timely appeal has been perfected to this Court.
